Collapse ▲Earlier this year, Prof. Nicholas Brown, editor at Farm Law & Tax, had an article published in the Drake Journal of Agricultural Law. The article provides a comprehensive overview of the legal and agricultural implications of the commercialization of post-emergent dicamba for cotton and soybeans.
While the paper is a formal article in a legal journal, it is designed to be easily digested by both farmers who are not attorneys as well as attorneys who are not intimately familiar with agriculture. The paper discusses how and why dicamba-tolerant crop systems were introduced into the agricultural market along with the subsequent issues of herbicide drift that occurred. Following that, the paper scrutinizes legal remedies for farmers who suffered damages and examines lawsuits that were filed against pesticide manufacturers. The paper ends with a review of common proposals to resolve and/or mitigate these issues.
The Drake Journal of Agricultural Law is considered the nation’s most prestigious agricultural law journal.
