Collapse ▲Now that the Lewis Tobacco Settlement claims process has been completed, many former tobacco quota holders are wondering what to expect next regarding this process. Specifically, when can those who have qualified expect to receive payments from this settlement?
On July 10, 2023, the Trustees filed in the Bankruptcy Court for the Eastern District of North Carolina their final objections to claims that the Trustees believe are deficient. Those growers who disagreed with the Trustees objections to their filed claims had until August 14, 2023 to file a response in the Bankruptcy Court for the Eastern District of North Carolina. The period for these individuals to file a response has ended.
Alan Runyun, Trustee of the Lewis Certified Settlement Class Trust, has informed the N.C. Cooperative Extension Center of Pitt County that the Bankruptcy Court is now scheduling hearings for those who filed responses. These hearings will likely be set for this fall and those who filed these responses in the Bankruptcy Court, and still wish to be heard will be notified when these hearings are scheduled. The earliest that this hearing process will be completed is likely to be the end of this year.
Any payments for approved claims cannot be made until the hearing process has been completed and the Court has ruled on all the matters before it. In terms of a timeline, the earliest that those who will receive payments will be in 2024. Payments are anticipated to be issued during the first quarter of 2024 but that cannot be guaranteed at this time.
